Public Offer Agreement

1. GENERAL PROVISIONS

1.1. This Agreement is an official public offer (hereinafter – Agreement) by Sole Proprietor Maria Ihorivna Koval, TIN 3929709247 (hereinafter – Seller), registered in the Unified State Register of Legal Entities, Sole Proprietors and Public Organizations, addressed to the Users of the website – individuals – for concluding a sales contract for goods remotely via the website https://catiche.com.ua (hereinafter – Website), under the terms defined in this Agreement.

1.2. Pursuant to Articles 633, 641, and 642 of the Civil Code of Ukraine, this Agreement is a public contract, the terms of which are mandatory for the Parties.
1.3. By accepting the terms of this Agreement, the User of the Website becomes the Buyer.
1.4. Acceptance of this Agreement shall be deemed the act of placing an order on the Website and/or payment by the Buyer.
1.5. The Seller reserves the right to amend the terms of this Agreement unilaterally without notifying the Buyer. The new version of the Agreement takes effect upon its publication on the Website.
1.6. This Agreement is valid from the moment the Buyer accepts it until full performance of the Parties’ obligations hereunder.

2. SUBJECT OF THE AGREEMENT

2.1. The Seller undertakes to transfer ownership of skincare products under the CATICHE brand (hereinafter – Goods) from the assortment available on the Website, and the Buyer undertakes to accept and pay for them under the terms of this Agreement.
2.2. Information about the Goods is provided on the Website in the product description along with images.
2.3. All information on the Website (descriptions, characteristics, recommendations) is for reference only and does not constitute medical or cosmetology advice.
2.4. The Goods do not contain harmful or prohibited ingredients; their composition is natural and carries a minimal risk of allergic reactions.
2.5. The actual appearance of the Goods may slightly differ from the images on the Website due to device color rendering differences or packaging design updates.

3. ORDERING PROCEDURE

3.1. Goods may be ordered by the Buyer through the Seller’s Website from the available assortment.
3.2. When placing an order on the Website, the Buyer undertakes to provide the following information: full name, phone number, email address, and delivery address (settlement, Nova Poshta branch number). If additional information is required, the Seller may request it. The Buyer is responsible for the accuracy of the information provided. Once the order is placed, the Buyer’s data is stored in the Seller’s database.
3.3. The name, quantity, assortment, item code, and price of the selected Goods are indicated in the Buyer’s shopping cart at the time of placing the order.
3.4. The Seller ensures the availability of Goods presented on the Website. In case of the ordered Goods being out of stock, the Seller may exclude such Goods from the order and/or cancel the order by notifying the Buyer by phone or email. In case of cancellation of fully or partially prepaid orders, the Seller refunds the value of the canceled Goods to the Buyer in the same method of payment within 3 calendar days.

4. PROMOTIONS

4.1. The Seller may conduct promotions, offer special deals, or introduce loyalty programs, the terms of which will be detailed on the Website.
4.2. As part of promotions, the Buyer may receive gift items at a symbolic price of 1 UAH, as specified in the promotion terms.

5. PRICES AND PAYMENT

5.1. The price of each Good is determined by the Seller and listed on the Website. The total order price is calculated by summing the prices of all included Goods. The contract price equals the order total.
5.2. Payment is made in Ukrainian national currency when ordering Goods on the Website, either via cashless payment through the Plata by mono internet acquiring system (JSC “Universal Bank”) or upon receipt of Goods (Cash on Delivery) at Nova Poshta branches, payable in cash or by bank card.
5.3. No minimum or maximum order value is set.

6. DELIVERY

6.1. Order processing and dispatch are carried out by the Seller within 1–3 days after order placement/payment.
6.2. Delivery within Ukraine is carried out by Nova Poshta.
6.3. The delivery time to the Buyer consists of the Seller’s order processing time and the Nova Poshta delivery time.
6.4. Packaging integrity and delivery deadlines are ensured by the delivery service. The Seller is not liable for delivery service performance or Goods damage during delivery.
6.5. Delivery to Nova Poshta branches is paid by the Seller. Delivery is free for the Buyer.
6.6. The Buyer must collect the Goods at the Nova Poshta branch and pay for them if shipped with Cash on Delivery.
6.7. If the Buyer fails to collect prepaid Goods from the Nova Poshta branch, reshipping will not be arranged, and payment will not be refunded.
6.8. Self-pickup of Goods is not available.

7. RETURNS AND EXCHANGES

7.1. According to the Law of Ukraine "On Consumer Protection" and Annex No. 3 of the Cabinet of Ministers Resolution No. 172 of 19.03.1994, perfume and cosmetic products of proper quality are not subject to exchange or return.
7.2. Goods may only be returned if:
- significant defects are found;
- damaged Goods are received (not packaging);
- Seller error in order fulfillment.
7.3. In such cases, the Buyer must notify the Seller in writing within 24 hours of receiving the Goods at catiche.cosmetics@gmail.com and provide proof (photo/video), bank details, copy of passport and tax ID, and a payment document.
7.4. Refunds for Goods are made to the Buyer’s bank card within 7 calendar days after the claim is confirmed.

8. WARRANTIES, DISCLAIMERS AND LIABILITY

8.1. The Seller guarantees that the Goods correspond to their description on the Website, declared specifications, and originality.
8.2. Due to individual sensitivity or intolerance to ingredients, allergic reactions are possible. The Buyer must review the composition on the packaging and perform a sensitivity test before first use.
8.3. The Seller is not liable for the Buyer’s choice of Goods, only for fulfilling the order correctly.
8.4. The Seller does not guarantee that the results of using the Goods will be identical to descriptions or expectations, as outcomes depend on the individual characteristics of the Buyer’s skin and body.
8.5. If shipment of Goods is delayed by the Seller for more than 3 calendar days, the Buyer has the right to cancel the order and receive a refund for the prepaid Goods.

9. FORCE MAJEURE

9.1. The Seller is released from liability for full or partial non-performance of obligations due to force majeure, including natural disasters, military actions, missile strikes or drone attacks, blockades, hacker attacks on the Website, technical issues with the Internet, or government/local authority decisions.

10. PERSONAL DATA

10.1. When placing an order, the Buyer provides personal data: full name, phone number, email address, and delivery address (settlement, Nova Poshta branch number).
10.2. The Seller processes personal data in accordance with the Law of Ukraine "On Personal Data Protection".
10.3. The Seller may use the Buyer’s contact details for informational and promotional mailings (email, SMS, messengers).
10.4. By placing an order on the Seller’s Website, the Buyer confirms full acceptance of this Agreement and consents to the processing of personal data for the purposes of fulfilling this Agreement. Consent remains valid for the duration of the Agreement and indefinitely thereafter. The Buyer is informed of their rights under the Law of Ukraine "On Personal Data Protection" and the purposes of data collection. The Buyer also agrees that the Seller may provide access to or transfer personal data to third parties without further notice, without changing the purpose of processing.

11. CLAIMS HANDLING PROCEDURE

11.1. Claims regarding defects of Goods must be sent to the Seller’s email: catiche.cosmetics@gmail.com.
11.2. To substantiate a claim, the Buyer must provide photo or video evidence of the defects.
11.3. Disputes are resolved through negotiation; if no agreement is reached, disputes shall be resolved in court under Ukrainian law.
11.4. If any provision of this Agreement is declared invalid by a court, the remaining provisions remain valid.
